Claim #25921274 To Whom It May Concern, I am writing to formally dispute Kia’s denial of warranty coverage for the engine failure in my 2013 Kia Sportage. Per communication with customer care, Kia denied my claim on the basis of “excessive mileage between oil changes.” However, this conclusion is not supported by sufficient evidence and does not meet the legal standard required under the Magnuson-Moss Warranty Act. My vehicle received regular oil changes at intervals ranging from approximately 5,000 to 13,000 miles using full synthetic oil designed for extended service intervals. While these intervals may exceed conservative manufacturer recommendations, they do not constitute neglect, nor do they establish that maintenance caused the engine failure. The engine failure occurred suddenly while driving at highway speed, resulting in a complete seizure and requiring an emergency stop. This type of abrupt failure is consistent with known defects in Kia’s engines, particularly rod bearing failure, and not indicative of progressive oil starvation or maintenance-related damage. Under federal warranty law, Kia bears the burden of demonstrating a causal connection between the alleged maintenance deficiency and the specific mechanical failure. A general assertion regarding oil change intervals is insufficient. To date, Kia has not provided evidence establishing that my maintenance practices caused or contributed to the engine seizure. Accordingly, I request the following: 1.All documentation supporting the denial of my claim, including: •Photographs of engine teardown •Inspection reports •Evidence of sludge, oil starvation, or restricted oil flow 2.A written explanation detailing how the oil change intervals directly caused the engine failure, rather than a known defect associated with this engine. Absent such evidence, the denial of coverage constitutes a breach of warranty under KIA’s engine settlement program and the Magnuson-Moss Warranty Act.

While driving in the carpool lane, the engine briefly cut-out and than a rattling sound was heard. We decided to immediately exist the free way at a left-side car pool exit as a precaution. Immediately after exiting, the car went into a complete stall. Had we remained on the freeway, we would have been stranded in the fastest lane with no shoulder and with traffic approaching from the rear at 70mph. Thus we likely avoided catastrophe. There was no warning light. The problems was later determined to be caused by a manufacturer defect resulting in a connecting rod bearing failure. Pursuant to a class action settlement the engine was replaced. I'm writing to let others know that this is a potentially life-threatening danger and that the knock sensor recall does not adequately address this. Also, the dealer mischaracterized the symptoms on the engine warranty invoice, misstating the narrative above, wrongly stating "customer states CEL started flashing when driving after light appeared vehicle would not accelerate properly or start." This quote is untrue. There was no warning, and the car stalled.
Have been denied replacement of 2013 Kia Engine due to insufficient records. The KSDS had been installed May 7, 2021. Was told because I did my own maintenance and I have receipts and dates when the maintenance was done reason for being denied. I used 5W 20 full synthetic motor oil which was over and above what the car called for and a new oil filter every time which shows on my receipts. Obvious by looking at the vehicle that it was in good shape and maintained well for being a 2013. When I presented this to Kia, they said that they have in writing that you can’t do this. All it says is that they recommend service being done by a Kia dealer . this is when I found out about the Magnus and Moss warranty act of 1975. I kept a log of service done in my car from 5, 16 2019 until present. The car just stopped in the middle of the city street. It gave no warning sensor did not work. It did not slow the car down.. my wife called AAA and had it towed to the closest dealer . Again, I have receipts of all my purchases of oil and oil filters from 2019. I appealed the decision with Kia in which they came back and gave me the decision they weren’t going to replace it. We have been without a car for close to a month. I don’t know where to turn. I will continue to work on this as much as I can do what I think is right. I will also contact a Better Business Bureau . I know of people that had zero maintenance records and not the KSDS and had their car repaired. Talking with the mechanics they said at first they were fixing everything now they’re trying not to fix everything we bought the car in 2018 with 70,000 miles right now. The car has 103,600 miles. We bought the car from a Kia used car dealer.
KIA America has rejected my appeal for an Engine replacement through the Recall , I had the KSDS, Knock Sensor Installed by North Town KIA 3900 Sheridan Drive Amherst NY , May 7 2021. The warranty I received mentioned to keep oil and filter changed every 7500 miles with 5 w 20 oil . The oil was changed by Myself and I have receipts every 5k miles or less. I was turned down for what KIA tech line said Insufficient maintenance . As in they are calling me a liar . I bought 5w 20 full Synthetic oil and filters on 12 occasions from Walmart that Fit my 2013 KIA Motor The weight was recommended by KIA and the Filters rated at 10K miles . Have worked on My cars since I was [XXX] old have thousands of dollars in tools. I do what ever maintenance that is still possible to do on newer cars . Brakes , Filters Fluid changes tire rotations Ect . If KIA would have mentioned in the Warrenty you need to take Videos I would have . Why are not receipts enough? Also the way the oil looks rite now ?? Clean on the dipstick. Have talked to 3 different car service technicians. And they said the same thing. If that motor was not maintained the oil would not look that good. I asked the dealer for the video that the technician does when they told me what I already knew. I paid 230 dollars for the diagnostic, They sent the video to KIA tech line. KIA told me I have to get a subpoena . To get a copy.. Does that tell you they may be hiding something?? So I have brought this to the attention of 3 different KIA dealers. They said hands are tied to to KIA tech line . My 2013 KIA Sportage looks as good if not better then some cars 3 years old .Everything works except The 2.4 liter motor with bad rod bearings. The car died while my Wife was driving it while at a stop light at a busy intersection. No light on dash no warning. What if it quit when she was at a high speed. No power steering, no power brakes??That is dangerous . This happened on September 4 2025, towed straight to the KIA Dealer . There were no warning lights illuminated. The dealer referred the contact to the manufacturer for assistance. The manufacturer was informed of the failure. The manufacturer informed the contact that the timeframe for the engine coverage extension had been exceeded, and the HECU not been replaced under NHTSA Campaign Number: 23V652000 (Service Brakes, Hydraulic). The manufacturer opened a case regarding the failure. The failure mileage was approximately 50,000.
I bought my car and then I received a letter stating that it had 1 recall. I called KIA to schedule the recall and they said there are 4 in total. I told them to get them all done because the closes KIA is about 45 min from my house. I took it in KIA called me said everything was done that I could go pick up my car. Then on 7/19/25 I am driving in the highway and my car stops accelerating I pull over turn off my car let it cool off and turn it back on. It moves and the moment I try to accelerate it the car stops again. Thank God I was able to arrive to a gas satiation at an exit and not have someone crash into me. I tried jump starting it and nothing. I tried turning it on again and smoke stated coming out from the engine. I had to tow the car to my house. I called my mechanic to check it and 3 codes showed up (C1611, C1612, C1613). I called KIA to let them know the codes and that I needed them to tow my car to their dealership. They proceed to inform me that 1 of the recalls were not fixed (the fuse) had to ordered and was not done. No one had informed me that when I picked up my car. They are not wanting to give me a solution and I have called 3 days straight.
my vehicle, 2013/ SL Sportage recently suffered catastrophic engine failure. I received a renotification from Kia regarding the software updates. Barely a week, [XXX], my engine seized in traffic due to rod failure which the software update could have prevented according to Metro Kia of Madison. I was also told by the same Kia authorized dealer that the repair would cost me $11,000 out of pocket in addition to the diagnostic fees of $210.87. I also contacted Kia Consumer Affairs at 1-800-333-4542 regarding this issue, but the representative told me that the defect is my responsibility as the owner of the vehicle. I think this is absurd and unacceptable. I’m a student who relies on this vehicle to commute to school. With the semester beginning and winter approaching, I can’t imagine being left without safe transportation which places me in a severely disadvantaged position. My engine failed due to the knock sensor recall a known issue on my 2013 Kia Sportage the recall is supposed to provide a lifetime warranty but I was denied coverage because the failure happened before I was able to perform the update as I was a new owner to the car and was unaware of the recall at the time I have been going back and forth with the kia dealership for almost 8 months now 4 of those the car was at the dealership because they said I had to pay a $170 the fee for them to inspect the car to see if kia would repair it or not it which I was told I would get a full report when I finally was able to pick my car up I was told the claim was denied "due to recall not being performed" and that's literally all the paper said no report no details nothing I do t understand why I had to pay $170 for something they could have just told me because they knew the recall hadn't been completed at the time of entry and why did it take 4months of my car being there just to tell me that just for them to tell me that furthermore the recall applies to the car not just the original owner and covers all known defects and considering the engine failure was because of the defect and not normal wear and tear I'm requesting that KIA replace the engine in my vehicle in a timely manner as this failure was of no fault of my own but something that came directly from the manufacturer at time of purchase and had there vehicle not had a recall that effects the engine and the notification of a possible problem with the engine then my vehicle would not require a engine at this time.

Later, while attempting to park more smoke was coming from under the hood and the neighbor also witnessed flames coming from the front of the vehicle. No further information was available. MY WIFE WAS DRIVING AND WENT AROUND A SEMI AND ALL OFTHE SUDDEN THE ENGINE STALLED AND SHE ALMOST GOT HIT BY THESEMI SHE HAD JUST PASSED. NEXT DAY TOWED IT TO KIA AND THE SAID THE ENGINE HAD SEIZED UP BUT THATTHE ENGINEWAS NOT WARRENTY BECAUSE IT HAD NOT THROWN A KNOCK SENSEOR CODE. WE HAVE MAINAINED THIS VEHICLE AND GOTTEN THE UPDATE FOR THE KNOCK SENSOR AND WERE ABOUT TO GIVE IT TO OUR SON AND GET OURSELVES ANOTHER KIA. DONT THINK THATS GOING TO HAPPEN NOW THATI KNOW KIA DOES NOT STAND BEHINDE THEIR PRODUCT OR CARE ABOUT THEIR CUSTOMERS.
Problem with the BCM, my signal lights, headlights and beeper is not working. My power lock doesn't work nor my beeper
My car has a recall on the engine due to the chance it could catch fire. I brought my car to the dealership to have them replace the recalled part and they returned the car to me without performing the work. They didn't tell me that they didn't fix the recalled part, but I happened to notice on the receipt a day later that it said "can't perform bulletin parts on backorder freeze".

I received a recall notification last year, I live about an hr and a half away from the nearest Kia dealer, so I wasn’t able to get my car in to be inspected until last spring at the Kia in Medford. Then I got another notice in the mail stating my vehicle was amongst the ones that needed the HECU recall service done. I called the Kia dealer in Eugene and the earliest they could get me in was August 2024. A day or two before my long awaited appointment, they called to inform me that the part was on back order and that they would call me once it became available again. I haven’t received any communication from them as of yet. My car has been mostly parked since then and I’ve been borrowing a friends vehicle because I don’t want to risk my daughter and i’s safety. I received another notice from the corporate of Kia, stating I haven’t gotten it done and they strongly urge me to get it taken care of, I’ve tried booking another appointment online twice and there’s no availability and I’ve called 3 times with no return call. On the last notice I received, I see it says to submit a complaint to safercar.gov
engine is seized due to overheating
I have owned this vehicle for two years and last week the engine started making a load noise after some research I found a safety recall from 2017 that Kia made an error in the machining process of the engine and could cause catastrophic damage and a major safety issue if happened while driving. This vehicle has been at the local Kia dealer and they refuse to do anything about the issue.

We were driving down the road and heard a whine. About 2 minutes later there was a pop in both front wheels locked we could not move and we cannot get them to unlock

My daughter has a 2013 Kia Sporage. Last week she was driving and the engine kept cutting off on the highway. She has had the recalled engine replaced last year and has 33,000 miles on it. When we took it to be checked out the guy said it could be the timing chain. The dealership said that was unlikely. It sounds like it’s not getting gas, so we put fuel injector cleaner in and it still isn’t running.

I had my vehicle in for a recall from Kia PI2103 for Kia to update the software in my Kia Sportage. Which was to install software that could help my engine from failing. This was performed on January 19th 2024. Along with this recall they were supposed to extend my warranty to 15 yrs 150,000 miles. Shortly after aout 500 miles later and a few weeks my engine developed a knocking noise. I took back to the dealer that performed the recall to have it diagnosed. They advised that it needs and engine and is part of the campaign but they needed to get prior authorization. After a month went by Kia determined because I never took the key tag out of the car that I would not be getting a new engine for not meeting the requirements. How they determined this is when a service advisor is making a repair order they use window tags to locate cars. Well, the advisor rather than using a new window tag used the one that was sitting on my seat. I would like Kia to honor their extended coverage and replace my engine at no charge. Attached is proof I had KSDS and also a copy of the Kia techline that the service manager gave me to show the reason.

On December 13, 2023, at 7:30am I noticed that the check engine light was on in my vehicle. I recently received an Important Safety Recall letter notice on November 14, 2023, regarding a defect with the safety of kia motor vehicles that were manufactured between 2011-2013, in which the defect can result in an engine compartment fire. I currently have a 2013 Kia Sportage so once I saw the check engine light, I was concerned due to the notice I received. I decided to take my vehicle to my nearest kia dealership per the WARNING that states that if you experience illumination of Malfunction Indicator Lamp (MIL) take the vehicle to the nearest dealership as soon as possible. I took my vehicle to the 7050 Ogden Ave Berwyn, IL 60402 location. I informed Rep that my check engine light was turned on. The Rep then stated that diagnostic testing can be done on the vehicle, but it would be $175.00. I stated to the Rep “NO”, I then informed rep that I have a Recall on my vehicle regarding the engine and I have a warranty due to the defect on the engine. I was then informed that I do have a warranty and that I would be good to go in which the car was covered. After it was confirmed that there was a Safety Recall and Warranty along with a statement from the Rep confirming that everything would be taken care of. I provided rep the keys to my vehicle around 8:00am and was informed that the mechanic would have to keep my car overnight to sufficiently diagnose the problem. I later talked to the service manager that stated the previous rep was out and it would cost $655 for the vehicle to be fixed. I informed him that I have a warranty that should cover the cost. I was later informed that the part is not covered under the warranty. I informed him that I do not want the service and he then stated that I would have to pay for the diagnostic testing for the car in the amount of $155.00. I was then told I would have to wait another day until the worker came in. I had to pay $100

I was driving to my destination on the local highway when my car began to make a noise like a knocking sound, I kept driving so I can get over and get to a street where I can pull over safely. The car started smoking, I can see it through my rear view mirrors, I begin to panic because my car seem to be slowing down and cars are going around me. At this point I was able to pull over, as I was pulling over the car came to stop on its own and completely shutdown. I contacted my insurance and had it towed to my mechanic who determined the engine needed to be replaced. I take good care of my car, there were no warning signs, no lights on in my car indicating that the car was in distress. I contacted Kia and explained what happened, I had to pay out of pocket to have it towed to Kia. I’m currently waiting for them to inspect it.
