THIS IS FOR 2 NHTSA RECALLS ISSUED 10/25/17 AND 10/30/17 NHTSA RECALL NUMBER17V676 AND NHTSA RECALL NUMBER17V683. IT IS NOW 3 MONTHS LATER AND BMW OF NORTH AMERICA STILL HAS NO REMEDY AVAILABLE! BOTH RECALL STATEMENTS CAUTION THAT "OVER TIME" THE PART COULD DETERIORATE, LEADING TO THE CAR CATCHING ON FIRE. SINCE THE CAR IS 10 YEARS OLD, I AM CONCERNED THAT THE BMW DEFINITION OF "OVER TIME" HAS BEEN MET, AND THEREFORE WE ARE LEFT WITH A NON-DRIVEABLE CAR DUE TO THEIR WARNINGS. HOW LONG SHOULD ONE WAIT WITH NO COMPENSATION, EITHER MOBILITY OR FINANCIAL?
NHTSA RECALL NUMBER17V676 AND 17V683 WERE ISSUED IN OCTOBER 2017. I HAVE NOT RECEIVED MY NOTICE THAT PARTS ARE AVAILABLE. I HAVE CONTACTED BMW AND THEY TOLD ME I WOULD RECEIVE ANOTHER NOTICE IN DECEMBER 2017. WE ARE PAST THE DEADLINE AND I HAVE NO WORKING AC OR HEATER DUE TO THE FAN GOING OUT AND WHEN I TURN THE CAR ON I GET A BURN SMELL. I CAN'T DRIVE THE VEHICLE.
OPEN RECALLS HAVE NO REMEDY WITHIN A TIMELY MANNER. IN OCTOBER 2017, BMW ANNOUNCED 2 RECALLS AFFECTING MY CAR: (1) BLOWER MOTOR WIRING AND (2) POSITIVE CRANKCASE VENTILATION (PCV) VALVE HEATER. ORIGINALLY THE ESTIMATED TIME FRAME FOR A FIX FOR BOTH ISSUES WAS DECEMBER 2017. IT IS NOW MARCH 2018, ALMOST 6 MONTHS AFTER THE RECALLS WERE FIRST ANNOUNCED, AND NOT ONLY ARE THE REMEDIES STILL UNAVAILABLE, BUT BMW HAS FAILED TO COMMUNICATE ANY INFORMATION RELEVANT TO THE AFFECTED ISSUES. DUE TO THE SERIOUS NATURE THAT THESE RECALLS COULD POTENTIALLY POSE, I FIND THIS ABSOLUTELY UNACCEPTABLE. THE OPEN RECALLS COULD POTENTIALLY LEAD TO THE CAR CATCHING ON FIRE EVEN WHEN NOT IN USE. ALTHOUGH I HAVE NOT YET BEEN AFFECTED BY THE POTENTIAL DANGERS OF THE RECALLS, EVERY TIME I USE THE CAR THERE IS A CONSTANT FEAR THAT IT MAY HAPPEN DUE TO THE LACK OF REMEDIES FOR THE RECALLS.

I WAS DRIVING MY CAR I WASN'T DRIVING MY CAR NO MORE THAN 15 MIN. I FELT MY AC CUT OFF THEN I SAW WHITE SMOKE ABOVE THE DASHBOARD I PULLED OVER AND SHUT THE ENGINE OFF AND RAISE THE HOOD UP NO SMOKE WAS COMING FROM THE ENGINE THE SMOKE WAS COMING FROM ABOVE THE DASHBOARD THEN FLAMES FELL OUT ABOVE THE GLOVE APARTMENT IN WHICH THE ENTIRE CAR CAUGHT FIRE MY CAR WAS WELL TAKING CARE OF NEVER HAD ANY MAJOR PROBLEM WIT MY CAR (A BMW CERTIFIED MECHANIC WORK ON MY CAR ) IM VERY DISAPPOINTED ABOUT MY CAR CATCHING ON FIRE FOR NO REASON AT ALL I COULD HAVE LOST MY LIFE.

THE VEHICLE WAS REPAIRED. THE CONTACT STATED THAT ON ANOTHER OCCASION WHILE DRIVING, THE ENGINE STALLED AGAIN WITHOUT WARNING. THE VEHICLE WAS TOWED TO AN INDEPENDENT MECHANIC WHERE IT WAS DIAGNOSED THAT THE FUEL PUMP NEEDED TO BE REPLACED. THE VEHICLE WAS REPAIRED. THE CONTACT STATED THAT WHILE DRIVING AT VARIOUS SPEEDS, THE ENGINE STALLED AGAIN WITHOUT WARNING. THE VEHICLE WAS NOT DIAGNOSED OR REPAIRED. NO WARNING LIGHTS ILLUMINATED. THE MANUFACTURER WAS NOT MADE AWARE OF THE FAILURE. THE APPROXIMATE FAILURE MILEAGE WAS 130,000.

I'M SUBMITTING THIS COMPLAINT PER INSTRUCTIONS ON LETTER I RECEIVED RELATED TO SAFETY RECALL ON BMW DRIVER SIDE AIRBAGS. ON AUGUST 15TH 2017 I WAS GIVEN A FOUR WEEK LEAD TIME FOR THE AIRBAG REPAIR TO BE COMPLETED ON MY BMW RELATED TO RECALL #16V071 BY MY LOCAL BMW DEALERSHIP (NALLEY BMW OF SOUTH ATLANTA) THEREAFTER I CALLED BMW USA AND THEY WERE OF LITTLE TO NO HELP TO SPEED THIS UP. BECAUSE OF THE RISK OF DEATH / SERIOUS INJURY ASSOCIATED WITH THIS RECALL MY CAR REMAINS OUT OF USE SINCE AUGUST 14TH 2017. FOUR WEEKS WAITING FOR A CRITICAL SAFETY REPAIR IS BEYOND A REASONABLE PERIOD OF TIME!! I DEMAND EITHER MY REPAIR IS CARRIED OUT IMMEDIATELY OR REPLACEMENT VEHICLE UNTIL IT IS.

MY CAR BEGAN TO RUN ROUGHLY AFTER A COLD START AS I WAS LEAVING MY OFFICE. AFTER A FEW SECONDS AND FEELING DECREASED POWER, I TRIED TO PULL OFF THE ROAD AND INTO A PARKING SPOT IN THE PARKING GARAGE AT MICROSOFT'S HEAD QUARTERS (WHERE I WORK). THE VEHICLE STALLED OUT. I WAS ABLE TO RESTART THE VEHICLE AND GET INTO A PARKING SPACE, BUT IT CONTINUE TO RUN ROUGHLY. I NOTICED AN INTENSE SMELL OF GASOLINE AND IMMEDIATELY TURNED OFF THE ENGINE. I EXITED THE VEHICLE AND CHECKED THE EXHAUST. IT WAS BLOWING WHITE SMOKE AND HAD GASOLINE DRIPPING OUT OF THE TAIL PIPES, I LET THE VEHICLE COOL DOWN AND RESTARTED THE ENGINE WITH ANOTHER PERSON OBSERVING THE TAIL PIPE. IT AGAIN WAS RUNNING VERY ROUGH AND HAD GASOLINE SPRAYING OUT OF THE TAIL PIPE. I IMMEDIATELY TURNED OFF THE ENGINE. THE CAR WAS TOWED TO A SERVICE CENTER. THEY HAVE DIAGNOSED THE ISSUE IS THAT 2 OF THE INJECTORS ARE STUCK IN THE FULLY OPEN POSITION. AS A RESULT, THE CAR IS UNSAFE (I WAS LUCKY THERE WASN'T A MASSIVE FIRE). PREVIOUSLY, I'D HAD THE HPFP (HIGH PRESSURE FUEL PUMP) REPLACED UNDER RECALL. I AM CONCERNED THAT THE RECALLED/REPLACED HPFP MAY ITSELF BE DEFECTIVE AND FAILED, CAUSING 2 INJECTORS TO FAIL SIMULTANEOUSLY (THERE'S STATISTICALLY NO CHANCE OF TWO INJECTORS FAILING SIMULTANEOUSLY WITHOUT SOME CAUSAL FACTOR UPSTREAM IN THE FUEL SYSTEM). ON CONTACTING BMW (IN BELLEVUE WA) AND BMW NORTH AMERICA, THEY HAVE REFUSED TO COVER THE REPAIR OR ACKNOWLEDGE THE ISSUE. I AM CONTINUING TO ENGAGE WITH THEM ON THE REPAIR, BUT BELIEVE THIS IS A MORE SERIOUS SAFETY ISSUE. HAD I NOT PULLED OFF WHEN I DID, THE VEHICLE COULD HAVE WENT UP IN FLAMES WHILE ON THE HIGHWAY.
PASSENGER AIRBAG SEAT MAT OCCUPANCY SENSOR FAULT. THE PROBLEM BEGAN WHENEVER A PASSENGER WOULD SIT ON THE SEAT, THE AIRBAG LIGHT WOULD GO ON. AFTER SOME TIME PASSED THE LIGHT STAYS ON PERMANENTLY. I NOTICED RECALLS FOR THIS PROBLEM IN PREVIOUS YEARS. UPON RESEARCHING, IT SEEMS TO BE A WIDE SPREAD PROBLEM THAT JUST ISN'T REPORTED. IT LEADS TO MANY JUST FIXING IT THEMSELVES, OR JUST BUYING BYPASSES TO AVOID FORKING OUT OVER $1200 TO GET IT FIXED. THE PROBLEM DOESN'T SEEM LIKE A NORMAL WEAR AND TEAR SITUATION, AND NEEDS TO BE ADDRESSED

THE VEHICLE WAS TAKEN TO AN INDEPENDENT MECHANIC WHO DIAGNOSED THAT THE KEY NEEDED TO BE REPLACED. THE VEHICLE WAS REPAIRED, BUT THE FAILURE RECURRED. THE DEALER WAS NOT NOTIFIED. THE CONTACT REFERENCED NHTSA CAMPAIGN NUMBER: 13V044000 (ELECTRICAL SYSTEM). THE CONTACT WAS CONCERNED THAT THE STALLING WOULD OCCUR AND COULD CAUSE A CRASH. THE MANUFACTURER WAS NOTIFIED OF THE FAILURE AND STATED THAT THE VEHICLE WAS NOT INCLUDED IN THE RECALL FOR THE ELECTRICAL SYSTEM AND NO PARTS WERE AVAILABLE FOR THE AIR BAG RECALL. THE MANUFACTURER INFORMED THE CONTACT THAT SHE WOULD RECEIVE A NOTIFICATION LETTER WHEN THE PART WAS AVAILABLE. THE APPROXIMATE FAILURE MILEAGE WAS 100,000.

THE DEALER (NEW CENTURY BMW, 1139 W MAIN ST, ALHAMBRA, CA 91801) WAS CONTACTED AND STATED THAT THE CONTACT HAD TO PAY FOR THE REPAIR. THE CONTACT RECEIVED NOTIFICATION OF NHTSA CAMPAIGN NUMBER: 16V071000 (AIR BAGS); HOWEVER, THE PARTS TO DO THE REPAIR WERE UNAVAILABLE. THE CONTACT STATED THAT THE MANUFACTURER EXCEEDED A REASONABLE AMOUNT OF TIME FOR THE RECALL REPAIR. THE MANUFACTURER WAS CONTACTED AT 201-571-5859 AND STATED THAT THEY HAD TO INSPECT THE VEHICLE AND WOULD CALL THE CONTACT BACK. THE APPROXIMATE FAILURE MILEAGE WAS 98,000.
DRIVING 65MPH IN HIGHWAY WHEN ENGINE TURNED OFF. SAFELY PULLED OVER. RESTARTED. DROVE ANOTHER 5 MILES, ENGINE TURNS OFF AGAIN. RESTARTED. INSTRUMENT PANEL HAD RESET EXCEPT CLOCK AND ODOMETER. FOLLOWING DAY CAR STARTED AND RAN. WHILE MAKING A LEFT TURN IN LOCAL ROAD, THE ENGINE TURNED OFF, STEERING LOCKED, ALMOST HITTING ANOTHER VEHICLE WHICH WAS TURNING RIGHT.
