REGARDING RECALL 16V-071 - BMW CENTER IS UNABLE TO REMEDY THE DEFECT WITHIN A REASONABLE PERIOD OF TIME. PARTS ARE NOT AVAILABLE AND IT HAS BEEN OVER 3 MONTHS. I AM REPORTING THAT BMW DOES NOT HAVE ADEQUATE PARTS AVAILABLE TO FIX THE RECALLED PART AND IS CAUSE A DANGER TO DRIVERS OF THIS VEHICLE (INCLUDING MYSELF!)

I OPENED THE DRIVERS SIDE PANEL TO REPLACE THE BULBS BUT FOUND THAT THE DRIVERS SIDE BRAKE LIGHT HOUSING WAS BURNED AND MELTED AND NEEDED TO BE REPLACED. AFTER LOOKING OVER OTHER LIGHTENING COMPLAINTS, IT SEEMS AS THOUGH THIS IS A COMMON ISSUE WITH THE 2008 BMW X5 AND A POTENTIAL FIRE HAZARD. THIS SHOULD BE ADDRESSED BY BMW BEFORE THERE ARE ANY FIRES AS A RESULT OF THE DEFECTIVE TAIL LIGHT HOUSING

TAKATA RECALL I CALLED BMW OF NORTH AMERICA LAST YEAR TO COMPLAIN ABOUT NOT RECEIVING A REPLACEMENT AIRBAG FOR MY 2008 BMW X5 3.0 SI. THEY TOLD ME IT WILL BE AVAILABLE TOWARDS THE END OF SUMMER 2016. I HAVE NOT RECEIVED ANY NOTIFICATION OF ITS AVAILABILITY UP TO NOW (LATE FALL 2017). I THINK THEY COMPLETELY IGNORED MY COMPLAINT. THE CATASTROPHIC RISK STILL EXISTS WITH MY CAR. I NEED NHTSA'S ASSISTANCE FOR BMW TO ACT ON THIS PROBLEM. I HAVE WAITED FOR OVER A YEAR NOW AND STILL NO ACTION FROM BMW.

I RECEIVED A NOTICE IN THE MAIL THAT I HAVE A IMPORTANT SAFETY RECALL FROM BMW OF NORTH AMERICA. THE RECALL IS FOR A DRIVERS FRONT AIR BAG MODULE. TODAY 3/31/2016 I CONTACTED TWO DIFFERENT DEALERSHIPS (FT. WORTH, TX LOCATION ON WHITE SETTLEMENT ROAD, AND THE ARLINGTON, TX LOCATION LOCATED OFF OF LAMAR AVE). BOTH LOCATIONS SAID THEY HAVE NO IDEA WHEN THE PARTS WILL BE COMING IN TO REPLACE THE AIR BAG MODULE. I FIND IT UNACCEPTABLE TO TELL ME ITS AN IMPORTANT SAFETY RECALL THAT COULD CAUSE RUPTURING AIR BAG RESULTING IN METAL FRAGMENTS IF I GET INTO A WRECK, AND NOT HAVE A DATE OF WHEN I CAN GET THIS CORRECTED.

I HAVE BEEN TRYING TO GET MY CAR REPAIRED UNDER RECALL CAMPAIGN #16V-071 SINCE MARCH 2016 WHEN FIRST NOTIFIED. THE DEALER (GLOBAL IMPORTS) STATES THEY DO NOT HAVE THE PARTS AVAILABLE. WHEN WILL THIS BE REMEDIED AND WHAT OPTIONS DO I HAVE ON THIS SAFETY ITEM?
TAKATA RECALL. I RECEIVED A NOTIFICATION BY MAIL FROM BMW THAT MY VEHICLE IS INCLUDED IN THE RECALL AND THAT THE DRIVER'S AND PASSENGER'S FRONT AIRBAGS WILL BE REPLACED. I RECEIVED THE LETTERS IN MARCH 2016 (RECALL CAMPAIGN # 16V-071) AND JULY 2016 (CAMPAIGN RECALL # 16V-364). I CALLED BMW OF NORTH AMERICA REGARDING THESE RECALLS AND I WAS TOLD THAT I SHOULD BE RECEIVE A LETTER OF THE AVAILABILITY OF THE REPLACEMENT PARTS TOWARDS THE END OF SUMMER 2016. WE ARE APPROACHING THE START OF SUMMER 2017 AND I HAVE NOT HEARD ANYTHING FROM BMW REGARDING THIS MATTER. I DO NOT KNOW IF BMW IS STILL GOING TO FIX THIS DEFECT. THIS IS A VERY IMPORTANT MATTER THAT NEEDS TO BE RESOLVED AS SOON AS POSSIBLE.

BILL PEARCE BMW (BILLPEARCEBMW.COM/) IN RENO, NV HAS IN NO WAY RESOLVED THESE RECALLS IN A TIMELY MANNER. I HAVE MADE AT LEAST 10 CALLS OVER THE LAST 17 MONTHS TO THEIR SERVICE/PARTS DEPARTMENT TO INQUIRE ON AVAILABILITY OF REPLACEMENT PARTS. THE ENGINE IS NOT RUNNING AT ITS OPTIMAL LEVEL AND IS POTENTIALLY GETTING DAMAGED AS A RESULT OF THE FAULTY FUEL PUMP THAT IS UNDER RECALL. I AM DRIVING AT MY AND MY FAMILY'S RISK DUE TO BOTH AIRBAGS AND FUEL PUMP NOT MEETING SAFETY REGULATIONS AND BMW IS BEING NEGLIGENT IN TREATING THESE 3 RECALLS AS A PRIORITY. I HAVE ALSO ESCALATED THE MATTER TO BMW CUSTOMER RELATIONS ON 7/26/17 AND AM AWAITING THEIR RESPONSE. THERE IS NO INCIDENT RELATED TO THIS COMPLAINT, BUT I STRONGLY BELIEVE THE VEHICLE IS NOT SAFE TO DRIVE. I HAVE INDICATED THE DATE OF THE FIRST COMMUNICATION RECEIVED BY BMW AS WELL AS UPLOADED A PDF VERSION OF THEIR INITIAL NOTIFICATION.

ENGINE, ACCELERATION SHUTDOWN (ON INTERSTATE HIGHWAY - 2/26/16); MONITOR DISPLAY FALSE MESSAGE OF "WARNING: ENGINE HOT; OVERHEATING." ENGINE NOT HOT OR OVERHEATED; COOL TO TOUCH. COOLANT LEVEL FULL. CAR DISABLED. CAR GAVE 45 SECONDS AT FULL ACCELERATION BEFORE SOUNDING HIGH PITCHED FAN NOISE, THEN DISPLAYING "WARNING MESSAGE" ON CENTER MONITOR, THEN LOSING PEDAL ACCELERATION POWER ON EXTREMELY BUSY INTERSTATE 87 SOUTH HIGHWAY AT NIGHT, WITH INTERMITTENT EMERGENCY SHOULDER ACCESS. DANGEROUS TO MAINTAIN MANEUVERABILITY TO SAFETY WITH HIGH VELOCITY TRUCKS AND CARS BARRELING ALONGSIDE VEHICLE. SUSPECTED PART DEFECT IS "ELECTRONIC TEMPERATURE GAUGE" SENSOR, CAUSING CAR TO INSTANTLY DISABLE WHEN IT ISN'T HOT. CAR IS SELDOM DRIVEN AND UNDER 40,000 MILES. AFTER PARKING SUV, DRIVERS SIDE DOOR WILL NOT UNLOCK/OPEN WITH DOUBLE PULL, HOWEVER, USING UNLOCK BUTTON (UNLOCKS ALL DOORS) DOOR WILL UNLOCK. IN AN ACCIDENT, ESPECIALLY ONE INVOLVING FIRE, THIS COULD BE A FATAL SAFETY ISSUE. WORKED FINE UP UNTIL YESTERDAY, NOW IT WON'T UNLOCK; MADE THREE TRIPS IN THE VEHICLE YESTERDAY AND THE ISSUE OCCURRED ALL THREE TIMES AFTER PARKING.

WHEN THE VEHICLE IS MOVING A RELATIVELY SLOW SPEEDS, IT REQUIRES AN EXCESSIVE AMOUNT OF PRESSURE TO BE PLACED ON THE BRAKE PEDAL IN ORDER TO STOP THE VEHICLE. ALSO, WHEN THE VEHICLE IS STOPPED,, IT TAKES AN EXCESSIVE AMOUNT OF PRESSURE ON THE BRAKE PEDAL TO KEEP IT STOPPED WHILE IN GEAR FOR EXAMPLE STOPPED AT A TRAFFIC LIGHT. IT IS EXPERIENCING A LOSS OF POWER ASSIST IN THE BRAKING SYSTEM. MY VEHICLE WAS COVERED BY A RECALL ISSUED IN 2013 BUT I NEVER RECEIVED ANY NOTICE OF THE RECALL, AND THEREFORE DID NOT GET IT REPAIRED AS IT WAS WORKING NORMALLY. IN MID-DECEMBER 2015 THE PROBLEM BEGAN AND I TOOK IT TO THE REPAIR SHOP WHO DIAGNOSED THE PROBLEM. HOWEVER, BMW SAYS THAT SINCE IT HAS BEEN MORE THAN 2 YEARS SINCE THE RECALL, THEY WILL NOT REPAIR THE PROBLEM AT NO CHARGE. THE BRAKE ISSUE WAS NOTED TO BE A SAFETY ISSUE WHICH COULD RESULT IN A TRAFFIC CRASH DUE TO LOSS OF POWER ASSIST IN BRAKING. SINCE I NEVER RECEIVED ANY NOTICE OF THE SAFETY RECALL, I BELIEVE BMW SHOULD PAY FOR THE NECESSARY REPAIRS TO MY VEHICLE TO RETURN IT TO SAFE OPERATION.

BATTERY REPLACED, BUT DID NOT REMEDY ISSUE. TURNED VEHICLE OFF, DID NOT START AGAIN, AS NOTED ON NAV SCREEN. NEXT DAY, STARTED WITH NO PROBLEM. TOWED TO SHOP, BUT COULD NOT DUPLICATE. DROVE ONE WEEK, THEN PARK BRAKE CAME ON. NEXT DAY, SAME ALERTS-THIS TIME WHILE DRIVING. DID NOT RESTART AFTER TURNING OFF. WAS ABLE TO START AFTER 24 HOURS, BUT COULD ONLY DRIVE A FEW FEET BEFORE TOTALLY SHUTTING DOWN IN MIDDLE OF THE STREET WHILE MAKE A U TURN. TOWED TO SHOP THAT NIGHT. NEXT MORNING, SHOP COULD NOT DUPLICATE, AS VEHICLE RAN SMOOTHLY. FOLLOWING WEEK, RETURNED TO SHOP FOR FURTHER TESTING. BATTERY REPLACED AND REGISTERED. WHEN PICKING UP VEHICLE, NOTICED NAV SCREEN WAS BLACK, WOULD NOT ILLUMINATE. 4 DAYS LATER, IT CAME ON, BUT WENT OUT AGAIN THE FOLLOWING DAY. THE NEXT DAY, ENGINE SHUT DOWN ON INTERSTATE. WHILE WAITING FOR TOW, WIPERS CAME ON, DOOR LOCKS AND WINDOWS WOULD NOT WORK. COULD NOT ROLL DOWN WINDOW OR OPEN DOOR TO TALK TO SAFETY PATROL. PATROL JUMP STARTED VEHICLE. IT WAS LATER TOWED TO DEALER (WHERE PURCHASED). NAV SCREEN IS STILL BLACK, DVD AND CD DO NOT WORK (CD CHANGER SPITS OUT CDS). SHIFTS VERY HARD BETWEEN GEARS. I AM VERY AFRAID TO DRIVE THIS VEHICLE, AS IT CUTS OFF INTERMITTENTLY AND WITHOUT NOTICE. IN OCTOBER OF 2015 WHILE MAKING A RIGHT TURN VERY SLOWLY INTO A ONE LANE DRIVE THRU, MY BMW X5 ACCELERATED CLIMBED UP A 2 FOOT WALL THAT WAS ON THE DRIVERS SIDE RODE THE FRONT DRIVERS SIDE WHEEL UPON THE WALL. NOW I HAD JUST GOT THE CAR BACK FROM THE DEALERSHIP 5 DAYS EARLIER WHEN THEY REPLACED THE WATER PUMP AND REPLACED THE 2 FRONT TIRES AND DID A WHEEL ALIGNMENT A $2500.00 JOB. IT WAS VERY SCARY LUCKILY THERE WAS NO PEOPLE OR ANOTHER CAR CLOSE BY. I IMMEDIATELY CALLED THE DEALERSHIP AND TOOK IT IN THE NEXT MORNING. I EXPLAINED WHAT HAPPENED I FELT THAT THE CAR HAD A MALFUNCTION WITH THE ACCELERATOR IT MADE THE CAR GO SO FAST AND HARD. IT WASN'T JUST A CRASH INTO THE WALL IT CLIMBED THE WALL. OF COURSE BMW SAID THE ENGINEER SAID THERE IS NOTHING WRONG WITH THE BRAKES OR DRIVE SHAFT? WHAT GETS TO ME IS THAT I JUST GOT THE CAR BACK FROM THE LOCAL DEALERSHIP. I FEEL LIKE THE POWER OF THE VEHICLE WAS SO STRONG AND POWERFUL THERE WAS NO WAY THAT IT COULD HOP ON THE WALL LIKE THAT AND NOT JUST CRASH STRAIGHT INTO THE WALL. OH SIDE NOTE THE VERY NEXT MORNING 10-12-2015 MY SISTER HEARD ON ABC MORNING NEWS THAT A BMW SUV JUST RAN INTO A GLASS WINDOW AT A STORE THE CAR ACCELERATED ON IT'S OWN!
STARTED THE CAR AND GOT "PARKING BRAKE MALFUNCTION" MESSAGE. THE PARKING BRAKE COULD NOT BE DISENGAGED AND CAR COULDN'T MOVE. FOLLOWED INSTRUCTION TO RELEASE THE PARKING BRAKE SO THE CAR CAN BE MOVED. THE CAR IS MOVABLE AFTER THAT, BUT THE PARKING BRAKE NO LONGER WORKED.
OVERHEATING ISSUE. I FIXED THE THERMOSTAT AND THE WATER HOSE BUT CAR IMMEDIATELY OVERHEATED ONCE I GOT ON THE HIGHWAY. THIS CAUSED THE CAR TO IMMEDIATELY SHUT DOWN ON THE FREEWAY. THIS WAS A VERY DANGEROUS SITUATION.
CAR STALLED AND THE MESSAGE APPEARED ON THE DASH BOARD "ENGINE TOO HOT. PULL OVER AND CONTACT BMW REPRESENTATIVE". THE ISSUE IS THE WATER PUMP GOING BAD CAUSING ENGINE TO BECOME HOT. THE DEALER IS SAYING THAT A NEW WATER PUMP IS REQUIRED.
WHILE DRIVING THE BRAKE PEDAL BECAME INOPERABLE. IT WAS VERY DIFFICULT TO PRESS THE PEDAL TO GET THE VEHICLE TO SLOW DOWN AND IMPOSSIBLE TO GET IT TO STOP WITHOUT ADDING COMPLETE PRESSURE. WE HAD TO SHIFT THE VEHICLE DOWN TO 1 LOW MANUAL TRANSMISSION TO SLOW DOWN ENOUGH TO STOP COMPLETELY. FROM THAT POINT, THE BRAKE PEDAL DID NOT WORK AT ALL SO THE VEHICLE IS INOPERABLE DUE TO SAFETY REASONS. I CHECKED FOR RECALL'S AND MY MODEL YEAR WAS RECALLED FOR THIS EXACT PROBLEM, HOWEVER I DO NOT HAVE A V8 ENGINE, SO BMW IS STATING I DO NOT QUALIFY FOR A RECALL. THE REAR BRAKE LIGHTS MOUNTED IN THE TAILGATE FAILED. THIS IS DUE TO A KNOWN FAULT ON THE E70 MODEL, WHERE THE POOR QUALITY SEALANT AND METHOD USED TO PREVENT THE INGRESS OF WATER INTO THE LAMP HOUSING FAILS. THIS LEADS TO CORROSION OF THE CONNECTOR HOUSINGS AND THE FAILURE OF THE UNIT WHICH MUST BE REPLACED IN ITS ENTIRITY AT GREAT COST. AS BMW ARE AWARE OF THIS HAPPENING (INDEED THEY ISSUED A SERVICE BULLETIN ADMITTING SAME ) SI B 63 11 10 AND THE ITEM IS A SAFETY COMPONENT, I FEEL THE CARS SHOULD BE RECALLED AND THE WORK UNDERTAKEN AT THE COST OF BMW AND NOT THE UNFORTUNATE OWNERS. I NOTED THAT THE VEHICLE WAS NOT RUNNING PROPERLY SO I TOOK THE SUV INTO AN AUTHORIZED BMW SERVICE CENTER TO BE INSPECTED AND REPAIRED. I WAS NOTIFIED THAT THE VEHICLE HAD EXPERIENCED A BURNED UP WIRING HARNESS FROM A SHORT CIRCUIT TO THE DISA VALVE ON THE ENGINE. I WAS ALSO NOTIFIED THAT CYLINDERS 1, 3 AND 5 HAD FAILED IGNITION COILS, WHICH WAS THE REASON FOR THE POOR OPERATING PERFORMANCE. I WAS ALSO INFORMED THAT THE VANOS VALVES WERE STICKING AND MAY NEED REPLACING. PRIOR TO THE POOR RUNNING PERFORMANCE, LAST YEAR WE EXPERIENCED THE CAR FILLING WITH SMOKE AND HAD TO EVACUATE THE CHILDREN AND ADULTS FROM THE CAR WHEN DRIVING THE CAR. THE CAR WAS INSPECTED AND NO PROBLEMS WERE DISCOVERED AND THE SMOKE DID NOT RETURN, NO CODES WERE FOUND. A FEW MONTHS LATER, NOVEMBER 2014, THE CAR SUFFERED A "MAJOR DRIVE FAILURE" WARNING MESSAGE AND WOULD NOT SHIFT INTO GEAR FROM AN ENGINE IDLE CONDITION. CAR WAS TOWED TO A BMW MECHANIC AND INSPECTED. IT WAS DISCOVERED THAT A FUSE HAD BLOWN AND WAS REPLACED WITHOUT FURTHER INCIDENT. FROM AN ENGINEERING AND DESIGN PERSPECTIVE, NO WIRE ON A CAR SHOULD MELT AND BURN, SINCE FUSES ARE REQUIRED TO PROTECT THE CIRCUITS TO PREVENT THAT VERY EVENT. BMW OF TURNERSVILLE, NJ COMPLETED THE INSPECTION UNDER INVOICE #[XXX]. I FELL BMW SHOULD REPLACE THE FAILED WIRING HARNESS AND DISA VALVE, SINCE IT CAUSED THE FIRE BY ITS FAILURE.
